Terms of Service and Privacy Policy

Testifly Ltd. (“Testifly,” “we,” “us,” or “our”) provides AI-powered software testing services and automated QA environments (the “Services” or “Platform”). By accessing or using our Platform, you acknowledge that you have read, understood, and agreed to these Terms of Service (“Terms”).

Eligibility

The Services are intended for users aged 13 and above. You affirm that you are at least 13 years of age, and that you are authorized to accept these Terms on behalf of your company or organization. If you are under the age of 13, you may not use the Services.

Use of Services

By using the Services, you agree that:

• You can form a binding legal agreement with Testifly.
• You will comply with these Terms and all applicable laws and regulations.
• You are authorized to represent your business or entity in accepting these Terms.

Subscription and Fees

To access the Services, you must subscribe to a service tier and pay the associated fees. All fees are exclusive of taxes, which you are responsible for. We may modify our pricing and subscription plans at any time with notice.

Trials

We may offer trials for evaluation purposes, either for free or at a discounted rate. Trial availability and eligibility are at our sole discretion. We may cancel or modify trials at any time. Subscribers are your authorized users. You are responsible for managing access and ensuring compliance with these Terms by your users.

Data and Privacy

All data processed through the Platform, including test cases, results, and logs, remains testifly property. You can reach out to [email protected] and ask for its deletion. Testifly does not access or store your proprietary test data beyond what is technically required to provide the Services. We implement security best practices but make no guarantees against unauthorized access. We do not process or store personal data beyond account credentials and billing details, unless explicitly authorized.

SSO and Third-Party Authentication Privacy Notice

Testifly allows users to sign in using third-party identity providers (“SSO Providers”), including but not limited to Google, Microsoft, GitHub, and Facebook. When you choose to authenticate through one of these providers, Testifly receives certain account information from the selected provider as permitted by the access scopes you approve during login.

Data Accessed Through SSO

Depending on the provider and the permissions you grant, we may access:

• Your name
• Your email address
• Your profile picture
• Basic account identifier (such as provider user ID)

We do not request access to your files, contacts, messages, calendars, repositories, or any extended permissions unless explicitly required for a specific feature and clearly displayed during consent.

How We Use SSO Data

We use the data received from SSO Providers solely for the following purposes:

• Creating and maintaining your Testifly user account
• Verifying your identity and enabling secure login
• Displaying your name or avatar inside the platform
• Assigning your account to your workspace or organization
• Essential functionality such as audit logs or user management

We do not sell, rent, or use SSO data for advertising or marketing. All usage of Google account data complies with the Google API Services User Data Policy, including the Limited Use requirements.

Storage and Retention

We store only the minimal profile information required to operate your account (typically name, email, and provider ID). We do not store your SSO password or authentication credentials beyond what is required for secure session handling. If you revoke access from your SSO provider, Testifly will no longer have access to that data. You may request deletion of your Testifly account and associated data at any time by contacting [email protected].

Data Sharing

We do not share SSO data with any third parties except service providers necessary to operate the Platform (such as cloud hosting). These providers are bound by confidentiality and data protection obligations. We may also disclose data if required by law.

User Control & Revocation

You may revoke Testifly’s access to your SSO account at any time through the identity provider’s security settings. Examples:

Revoking access may limit or disable your ability to log into Testifly.

Account Security

You are responsible for maintaining the security of your account and devices. Testifly is not liable for any unauthorized access resulting from your negligence, weak credentials, or third-party integrations.

Acceptable Use

You agree not to:

• Resell, sublicense, or provide access to the Platform to unauthorized parties.
• Reverse-engineer, copy, or modify the Platform.
• Use automated systems to access or extract information from the Platform.
• Upload harmful code or content.
• Use the Platform for illegal purposes.
• Attempt to gain unauthorized access to any systems.
• Use the Services or Content for non-personal or commercial purposes without a separate agreement.
• Harvest or collect personally identifiable information about other users without their express consent.
• Take any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure.
• Create a database by systematically downloading and storing all or any of the content from the Site.
• Create a browser or border environment around Testifly’s Content (no frames or inline linking is allowed).

Third-Party Integrations

The Platform may integrate with third-party tools like Jira, GitHub, or CI/CD pipelines. Testifly is not responsible for the functionality, data security, or terms of such third-party services. Use is at your own risk and subject to those providers' terms.

Licensing and IP

We grant you a limited, non-exclusive, non-transferable license to access and use the Services during your subscription period. All intellectual property rights in the Platform, including AI models and automation algorithms, remain with Testifly.

Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.” We do not guarantee uninterrupted access, accuracy of results, or suitability for your specific needs. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of Liability

In no event shall Testifly or its affiliates be liable for any indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities. Our maximum liability shall not exceed the amount you paid to Testifly in the three months preceding the claim. This limitation applies to the fullest extent permitted by law. You will not, and waive any right to, seek to recover any other damages, including consequential, lost profits, special, indirect, or incidental damages from us and from Testifly’s representatives.

Indemnification

You agree to indemnify and hold harmless Testifly, its affiliates, and employees from any claims or liabilities arising from your use of the Services, your breach of these Terms, or misuse of test results or integrations. This defense and indemnification obligation will survive these Terms. You agree not to settle any matter subject to indemnification by you without first obtaining our prior express written approval.

Termination

These Terms remain in effect until terminated by either party. Testifly may suspend or terminate your access for violations or misuse. You may cancel your subscription at any time; however, no refunds will be issued for payments already made. The following sections will survive termination: Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Miscellaneous.

Governing Law

These Terms are governed by the laws of the state of Israel. You agree to submit to the exclusive jurisdiction of the courts located in Haifa, Israel. Any cause of action that you may have arising out of, or related to, the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

Amendments

We may update these Terms from time to time. Continued use of the Services after updates implies acceptance. We will notify users of material changes via email or dashboard announcements.

Miscellaneous

These Terms constitute the entire agreement between you and Testifly. You may not assign or transfer your rights without our written consent. Any conflicting provision with applicable law shall be interpreted to reflect the parties' original intent. No waiver of any term shall be deemed a continuing waiver. These Terms do not, and shall not be construed to create any partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship between the parties.
